Please read carefully and attentively these terms and conditions of use as well as our Privacy Policies before accepting and beginning to use our services.
These terms and conditions govern the relationship and services between you (the user) and Obsidiam, an entity registered and operating under the laws of Costa Rica under the name Obsidiam Investment Group S.A, also known as (Obsidiam or the Platform), with its representatives, the administrators, located in San José, Costa Rica.
GLOSSARY#
Digital Asset: a product that exists only online and that has economically measurable value by financial indices of fiat currencies. The best known are crypto-assets.
API: Application Programming Interface, a set of rules and protocols that allows different software programs to communicate with each other. It functions as an intermediary that allows one application to use the features or data of another, simplifying the integration between systems.
Anti-phishing: security measures that protect against phishing attacks, such as software, tools and training, aimed at preventing the theft of information.
BaaS: stands for Banking as a Service, a financial solution that allows non-banking companies to offer banking services (such as digital accounts, cards and payments) through the infrastructure of partner banks, using APIs.
Background check: a verification of background in an investigation process to validate the history of a person or company, which may include information about criminal, financial, educational and professional background.
Blockchain: a distributed and decentralized digital network model that records transactions in a secure, transparent and immutable way. Instead of relying on a central intermediary, such as a bank, the technology uses a network of computers to validate and record information in cryptographically connected blocks, which guarantees the integrity of the data and makes fraud difficult.
Chat: a form of remote communication, using computers connected to the internet.
Customer: a Legal Entity duly incorporated in Brazil that holds an account in a Wallet capable of providing custody of the crypto-assets it acquires through the Platform.
Digital Account: a bank or payment account that can be opened and operated entirely online, through an application or website, without the need for physical branches. They generally do not charge maintenance fees and offer services such as transfers (Pix, TED), payments and withdrawals, available at any time and place, provided there is internet access.
Compliance: a set of disciplines aimed at complying with and enforcing legal and regulatory rules, the policies and guidelines established for the business and for the activities of the institution or company, as well as preventing, detecting and addressing any deviations or non-conformities that may occur.
Crypto-assets: digital assets protected by cryptography that use blockchain technology to be recorded and transferred electronically on a decentralized network, without the need for intermediaries such as banks. They can be used for payments and investments, with cryptocurrencies, such as Bitcoin and Ethereum, being the best known. Other types include tokens, stablecoins and NFTs.
Cryptocurrency: a digital or virtual form of currency that operates independently of traditional banking systems through the use of cryptography to protect transactions and control the creation of new units. It is a type of crypto-asset.
Cryptography: the process of protecting data by transforming it into an unreadable secret code (ciphertext), which can only be deciphered with a security key.
Evidence: any document or information that can prove a fact or the communication carried out between persons and companies.
IP: Internet Protocol, a numerical system that identifies devices on networks for communication, with each device connected to the internet being linked to an IP.
KYC: an acronym for "Know Your Customer," which in Portuguese means "Conheça Seu Cliente." A mandatory process that companies, mainly those in the financial sector, use to verify the identity, authenticity and reliability of their customers. The objective is to prevent illegal activities, such as money laundering and fraud, and to ensure regulatory compliance.
LGPD: The General Data Protection Law (Lei 13.709/2018) has as its main objective the protection of the fundamental rights of freedom and privacy and the free development of the personality of the natural person. It also focuses on creating a scenario of legal certainty, with the standardization of regulations and practices to promote the protection of the personal data of every citizen who is in Brazil, in accordance with existing international parameters.
MED: Mecanismo Especial de Devolução (Special Refund Mechanism) is a Pix feature created by the Banco Central do Brasil to facilitate the recovery of amounts in the event of fraud, scams, or proven operational errors.
Fiat currency: a type of currency issued by governments and authorized by governmental regulation to be legal tender, such as the Real, the Dollar and the Euro.
OTC: Over-the-counter is a decentralized market in which participants trade stocks, commodities, currencies or other assets directly between the parties, without the intermediation of a central exchange or broker.
Operation: Each and every transaction of purchase and/or sale of a Crypto-asset, carried out by the User through the use of the features and services made available by Obsidiam.
Platform: Non-customizable licensed software for business management, operated independently or in partnerships by Obsidiam, which offers services relating to operations carried out with crypto-assets, including intermediation in the purchase and sale of cryptocurrencies, the opening of a digital payment account and integration for currency exchange.
P2P: "peer-to-peer," a network model where computers connect and interact directly with one another, without a central server. This technology is used to share files (such as in BitTorrent), make payments (such as Pix) and for peer-to-peer lending (direct loans between investors and borrowers). The main benefit is decentralization, which can reduce costs, increase privacy and flexibility.
PLD: a set of policies, usually organized in a document, with procedures and internal controls that financial institutions and other regulated entities implement to detect and prevent the crime of money laundering and the financing of terrorism (PLD/FT).
SaaS: an acronym for Software as a Service. It is a software distribution model in which the application is accessed over the internet through a subscription, without the need for local installation.
Selfie: a photograph that someone takes of themselves, usually with a mobile phone, and that can be shared on social networks and used for identity confirmation.
Token: digital assets that represent value or utility on a blockchain, which may be the digital representation of a real asset (such as stocks, real estate or art) or have other functions, such as governance, payment and access to services.
USDT: a cryptocurrency hosted on the Ethereum and Bitcoin blockchains and backed by the US dollar, named Tether and called a stablecoin because it was originally designed to always be worth US$1.00 (one dollar).
Wallet: in this context, refers to a digital application item that stores money, cards and other items. Digital wallets (e-wallets) allow you to keep credit cards, debit cards, tickets, transport cards and other documents on a smartphone for contactless payments and the management of digital items. In the context of cryptocurrencies, a wallet is software or hardware that stores private and public keys to access digital assets on the blockchain.
1. DESCRIPTION OF SERVICES#
Obsidiam is a platform dedicated to facilitating the activities of purchasing, selling, and forwarding digital assets, in addition to digital payment account and currency exchange services. The digital asset that you may acquire consists of cryptographic tokens, classified as cryptocurrencies. Not all types of digital assets will be available; only those that appear in the "digital wallet" section of the platform will be available for trading.
The following services are available on the platform:
- Opening of digital payment accounts;
- Purchase and sale of digital assets between users (P2P);
- Exchange of fiat currencies.
Transactions on the platform that do not involve the purchase and sale of crypto-assets must be carried out by means of fiat currencies.
The platform does not provide advisory services for trading, purchasing, or selling digital assets, including cryptocurrencies. Obsidiam, as part of its services offered in the purchase and sale section, will act only as an intermediary (OTC) in the formalization of the interest to purchase, and shall be remunerated per operation in accordance with its rules.
2. ACCEPTING THE TERMS AND CONDITIONS OF USE ON THE PLATFORM#
At the moment you enter or use the services of Obsidiam and its partners through the website (https://www.obsidiam.com) or the application, you (the user) accept that you have read, understood and accepted the terms and conditions of use of the platform. You also agree that your personal information will be processed and used in accordance with the privacy policies pursuant to the General Data Protection Law of Brazil – Lei 13.709/2018. Minors and natural persons are not permitted on the platform.
The use of the platform's tools may give rise to financial risks, because by entering, the user accepts that Obsidiam will not be financially responsible for the improper use of these transactions, whether due to lack of experience, confusion or negligence in protecting their credentials for accessing the platform or their digital wallets.
You also agree that the digital assets you have acquired on the platform may present volatile movements in their prices, and therefore you agree that Obsidiam will also not be liable for the financial losses caused by these movements.
By entering, registering or requesting the use of any feature, the user declares their capacity to transact and does so without any legal impediment, as well as that they will not use our system for unlawful purposes.
3. MODIFICATION OF THE TERMS AND CONDITIONS#
Obsidiam reserves the right to unilaterally modify the terms and conditions for reasons such as, among others, security reasons, applicable regulatory provisions, requirements, changes or modifications to the applied technology or due to adjustments to the business model developed by Obsidiam.
Any modification to the terms and conditions will be communicated within 15 days through the platform's communication channels, except for changes that involve security problems, compliance with legal regulations or suspected fraudulent activities, which do not require prior communication and may take effect immediately after the communication.
The use of the platform after the changes to the terms and conditions take effect will constitute an express and unequivocal manifestation of acceptance of the changes or modifications made. If you do not agree with the changes, you must follow the procedure for closing the account in the user profile of the platform.
4. PROHIBITIONS OF USE#
By registering or entering the platform, you declare that you do not appear on any list of commercial or economic sanctions of any country, such as the UN Security Council, OFAC (Office of Foreign Assets Control), the Trade Department of the United States of America, or on the Wanted List of the Federal Police of Brazil (PF) within the scope of action and collaboration of Interpol.
You agree that you are responsible for the obligations of your local legislation when using the platform. Thus, if the laws of your country prohibit the use of our services, you must not access or use the platform.
Obsidiam reserves the right to select the countries, markets and jurisdictions to which it will offer its services and may restrict or deny the services, at its discretion, to certain countries or nationalities.
Natural persons may not transact crypto-assets on the platform, and no registration of persons who are minors under the legislation of their nationality will be permitted. In Brazil, the minimum age permitted is 18 full years, provided that the person is linked to a legal entity (company) in the capacity of managing partner.
5. USER REGISTRATION AND VERIFICATION#
5.1 REGISTRATION#
To access the platform, you must complete the registration stage, which will include an available username, a password containing at least 8 characters, an email and a telephone number that you use. For some services, such as intermediation via OTC, the registration data may be collected through background check platforms.
To complete the registration stage, it is necessary to use a mobile phone that you use, where you will download the two-factor authentication application required by Obsidiam depending on the service contracted.
It is prohibited to sell, deliver or leave your data freely accessible to third parties. And any violation of this rule may result in the suspension or closure of the account.
You have the right to delete your account and terminate the contract relating to it at any time, but you will be responsible for all obligations that arise before the termination of your account, judicial and extrajudicial.
Irregular registrations and sign-ups, under the prohibited terms (item 4), will be deleted without the need for notification.
The registration of corporate customers must comply with the following rules:
a) To open a digital payment account, submit the following documents:
- Articles of association with the latest update
- Company CNPJ
- Proof of company address
- Identity document of the managing partner
- Proof of address of the managing partner.
b) To purchase crypto-assets, submit the following documents:
- Articles of association with the latest update
- Company CNPJ
- Proof of company address
- Identity document of the managing partner
- Proof of address of the managing partner
- PLD duly signed by the managing partner
- Copy of the last three declarations under IN 1888/2019
- Balance sheet or income statement (DRE) of the company's last fiscal year.
5.2 IDENTITY VERIFICATION#
To use the services and products of the platform, through a rigorous onboarding process, you must validate your identity, as this is necessary to comply with Obsidiam's Policies and Procedures regarding KYC (Know Your Customer), counter-terrorism rules, prevention of money laundering, prevention of fraud and other financial crimes (PLD/AML).
Identity verification is carried out by validating your email, mobile phone number, official identification document issued by the government of your country of residence or citizenship and a photo taken in real time (selfie), in addition to other documents and information that the platform deems necessary and required.
If there are well-founded doubts about the information or documents provided being incorrect, expired, illegal or incomplete, Obsidiam has the right to reject your request or registration and/or to require the information or documentation necessary to validate your identity.
If the identity document is of doubtful origin, our rigorous anti-fraud system will not validate it, and therefore Obsidiam will request one or more documents or information necessary to validate your identity or will suspend your account, as applicable.
You are required to provide correct, true and accurate information or documents. Any attempt to falsify your identity is prohibited and may immediately lead to the suspension or closure of your account.
Obsidiam is not obligated to disclose or justify the reasons why your identity verification was rejected for any type of service contracted.
By providing the data or documentation requested in the registration and identity verification, you authorize Obsidiam to share your personal information with third-party suppliers whenever necessary, for the main, but not necessarily exclusive, purpose of validating your identity, protecting you and/or Obsidiam against fraud, financial crimes or any other reason, and may use consultation of public databases of personal information, including criminal records.
You also agree that your personal information may be shared with governmental criminal investigation bodies, if there is suspicion of unlawful activity or if required by them, in compliance with the rules of the LGPD.
6. SECURITY#
6.1 LIMITS OF THE CUSTODY OF DIGITAL ASSETS#
For the OTC service, related to the intermediation of the acquisition of crypto-assets, the platform will not provide any type of prolonged custody of these assets, and the buyer must correctly inform the Wallet that will receive the quantity of cryptocurrencies acquired and, if retention or custody is necessary, the platform will do so only for the time necessary to verify the security, lawfulness and regularity of the transaction or for matters related to the locking of the purchase/sale price in the case of crypto-assets backed by fiat currency (USDT, USDC).
It is the exclusive responsibility of the buyer user to correctly inform the address of the Wallet to which the acquired crypto-assets will be sent, considering that the transaction is irreversible. Errors in the addresses of the destination wallets are attributed exclusively to the requesting user.
When the user is linked only to a payment account in the BaaS system, the custody of the assets will take into account the deposit, withdrawal and transfer process of each account, applying the rules and fees relating to this type of service offered by Obsidiam.
In addition, as part of our security measures to protect financial assets, you agree that Obsidiam may temporarily and without prior notice restrict the transfers or withdrawals of your digital assets, due to system failures or cyberattacks on its systems, suspicion of theft or illegal activities in your account or any other reason.
6.2 SECURITY OF THE PAYMENT ACCOUNT#
Obsidiam constantly implements and updates a rigorous system of protocols to protect your accounts. However, there are security risks associated exclusively with the actions of the users who hold the accounts, who must collaborate for the security and soundness of the entire system.
You agree that you must treat your access credentials as confidential and will never pass them on to third parties. You are responsible for taking all security precautions to protect access to your account and your personal information. You also agree that you are responsible for notifying Obsidiam if any activity occurs on the platform that has not been authorized by you.
In addition to the initial credentials (Username and Password), the platform may use other optional security methods. You agree that you are responsible for the implications and vulnerabilities of deactivating options such as: Two-factor authentication, Withdrawal allow list, Anti-phishing code and Access management by IP.
When applicable, the two-factor authentication system may be disabled only for access to the platform; it is not permitted to deactivate it for cancellations or transfers of financial assets. You agree and understand that any loss of access to your two-factor authenticator linked to your Obsidiam account means that you will need to carry out the account recovery process in order to be able to access it, make withdrawals or make changes to your user profile.
Obsidiam reserves the right to temporarily limit your access to the platform, when it is necessary to carry out maintenance, due to security failures or any other fortuitous situation that temporarily removes your access to your account, or, further, due to suspicions of fraud in operations considered unusual.
6.3. ACCOUNT RECOVERY#
Your account can only be recovered by contacting Obsidiam Support. You understand that it is your duty to contact them if any problem with your access credentials arises or if you have been suspended due to some suspicious activity.
In the process of recovering your account, Obsidiam may require you to verify your identity, and for this you will have to submit your identity document and carry out a real-time proof of life, such as a selfie. You understand and agree that Obsidiam will only recover your access to the account if the identity validation documents previously submitted are consistent with the new documents requested.
In the face of any suspicion of irregularity in the account recovery process, Obsidiam reserves the right to request the documentation necessary to prove your identity. You agree that, during this process (with no defined deadline), access to or withdrawal of funds will be temporarily blocked.
In the event of the death or incapacity of the account holder, Obsidiam reserves the right to request the legal documentation necessary to prove the occurrence, in addition to requesting the necessary documentation from the successors or legal representatives. In this case, Obsidiam will grant only temporary access to the legal successors or persons legally authorized to withdraw all the funds. After the total withdrawal of the funds, the account will be deleted.
7. DEPOSITS AND WITHDRAWALS OF DIGITAL ASSETS#
7.1 DEPOSITS IN THE BAAS SERVICE#
Deposits of assets on the platform must be made to the address corresponding to that asset (account number); you agree that if you deposit assets that do not meet the rules linked to your account, you may incur additional costs, for which Obsidiam will not be liable.
Obsidiam may change the addresses of the digital wallets at its discretion, if possible. Thus, you agree that it is your responsibility to be attentive to communications regarding changes of addresses or another method of identifying the bank account, as well as to review these for your wallet before forwarding or depositing assets.
For security measures, Obsidiam reserves the right to suspend your account without prior notice, if it detects that a suspicious deposit has occurred coming from an address involved in illegal activities.
The platform may use the services of partners to offer digital payment accounts under the "banking correspondent" model, and you declare that you agree with these conditions.
7.2 WITHDRAWALS IN THE BAAS SERVICE#
Withdrawals of assets can be made in the withdrawals section of the platform. By doing so, you agree and confirm that you must correctly enter the destination data, as the transfer is irreversible and Obsidiam will not be liable for the loss resulting from user errors.
As a security measure, Obsidiam may impose daily limits on the number of withdrawals. By using the service, you agree that you will not be able to make more withdrawals on the same day if you exceed the established limit.
Obsidiam will charge a fee for each withdrawal, in accordance with what is stipulated in this or other rules available on the platform's website, and the commissions will be charged in the digital asset of the user's preference, depending on each case, deducted from or added to the amount withdrawn. In addition, Obsidiam may establish minimum amounts for withdrawals.
At Obsidiam we are committed to maintaining the best possible service; however, we reserve the right to temporarily suspend withdrawals or present delays in them for technical reasons, system maintenance or any other situation that justifies it.
Furthermore, for security measures, Obsidiam reserves the right to suspend your account without prior notice, if it detects that a withdrawal was made to a suspicious address involved in illegal activities, and the user must, immediately upon request, send the evidence that is available to Obsidiam.
8. PURCHASE AND SALE OF CRYPTO-ASSETS#
8.1 PUBLIC OR PRIVATE OFFERS#
The platform may make public or private offers for the purchase or sale of crypto-assets through the OTC (Over-The-Counter) model. These offers must indicate the price, quantity, payment methods, in order to be accepted, as well as the specific data or instructions to carry out the transaction. You agree that you are solely responsible for reviewing the data for the completion of the operations.
You agree and understand that the payment date and the relevant instructions for sale offers must not involve a third party, except for the hypothesis of purchase via OTC, and the purchase and sale orders must benefit only the participants in the transaction (party and counterparty). Failure to comply with this rule constitutes a violation of these terms and may result in the suspension or closure of your account.
Obsidiam has the right to limit the offers; the price of the asset, the quantity and the payment/exchange method that it considers appropriate, as well as reserving the right to exclude offers that present illegalities in their description, or that appear fraudulent or are conveyed by spam.
By selecting the option to make your offer at the market price or within a margin above or below the market price, you agree that your offer may undergo constant price variations, and the platform is not responsible for locking the purchase/sale price if it verifies high market fluctuation.
When applicable, the offers have a mandatory validity period, which may be modified by you within the options offered by the platform. Obsidiam reserves the right to make modifications among these options based on its own criteria.
Private offers, when permitted by the platform, generate a code, which you must share only with the counterparty. Obsidiam is NOT responsible for the means and the reach of the disclosure of the information contained in the offers, by the counterparty or by third parties who have had access to the code or the offer information, nor is it responsible for the confidential information that you share.
By accepting a proposal, the offer becomes an active order in the trading window. Consequently, you agree that you are entering into a legally binding contract and agree to comply with the established terms and conditions, such as price, quantity, payment instructions.
Under no circumstances will there be a delivery of crypto-assets before payment by the buyer user into the corresponding account and at the price and currency agreed in the operation. Nor will any amount of crypto-assets be transferred to wallets that are sanctioned, listed or restricted in checking systems.
8.2 TRADING WINDOW#
When starting a transaction in the trading window, it is necessary that both parties are active or available on the platform. Therefore, you agree that, if you are inactive or unavailable during the transaction, this may have negative consequences for you, in the event of a dispute or cancellation of the transaction, and during this process, the assets involved in the transaction will be blocked until the operation has been completed or canceled.
The active orders in the trading window are under the supervision of Obsidiam; therefore, you understand and agree that all communication, forwarding of files or images with the other party related to the transaction, must be done only through the available trading system.
In addition, you understand that all communications within the platform are not private between the party and the counterparty of the operation and they may be monitored by Obsidiam's agents and may be taken into consideration if an eventual conflict occurs.
We emphasize that you accept and agree that all communication that does not occur within the platform, whether it is hidden, encrypted, or obstructed from Obsidiam's view, will not be taken into consideration in conflict resolutions.
The information contained in the trading window, such as the user's personal data, specific data or instructions to make the payment, and the information sent through the Chat (conversations, files or images), are considered confidential between you, the counterparty and Obsidiam; however, the platform is not responsible for the disclosure of this information by you, by the counterparty or by third parties who have had improper access to it.
All information managed and monitored by Obsidiam in any transaction will be processed in accordance with our privacy policies.
8.3 BUYER#
If you are the buyer in the transaction, you must comply with the payment instructions provided by the OTC, within the period established by the platform.
The period may vary according to the payment method and Obsidiam reserves the right to change the periods at its discretion, and you will NOT have the right to request one or more extensions of the payment period.
If the initial period expires and you have not confirmed the payment, the transaction will be automatically canceled, regardless of whether the payment was made after the cancellation.
Before making the payment, you are responsible for verifying that the payment instructions or data correspond exclusively to the seller (OTC) and NOT to third parties; by accepting these terms, you agree that any payment made for digital assets to third parties who are not a seller licensed by the platform may have consequences for which Obsidiam is not responsible.
You also agree that the payment to the seller must be made from accounts owned by you and not from accounts of third parties. Failure to comply with this rule constitutes a violation of this contract and may result in the suspension or closure of your account.
After confirming the payment sent, you agree and understand that you must wait for the OTC to also confirm it in order to receive your assets in the wallet indicated by the buyer, which must be a legal entity duly incorporated in Brazil.
Due to the common market fluctuations of crypto-assets backed by fiat currencies, you as the buyer may not cancel the transaction unilaterally, especially if you have already made the payment or the receipt of the tokens in the respective destination wallet.
8.4 SELLER#
The sale of crypto-assets within the platform will be carried out exclusively by an OTC linked to Obsidiam, which will carry out operations only after approval of the registration of the buyer user who passes through the compliance procedure managed by legal professionals not linked to Obsidiam.
After receiving confirmation of payment, the OTC will have a period determined on the platform to confirm receipt of the payment. The period may vary depending on the payment method used, and Obsidiam reserves the right to change these periods at its discretion and to adopt additional layers of verification.
You agree that Obsidiam and the OTC may verify the integrity and regularity of the wallet informed for the transfer of the crypto-assets after confirmation of the payment and, if there is any irregularity that makes it impossible to complete the transfer operation, the buyer will assume all expenses related to the return and refund, especially the payment of fees, taxes and charges that will be automatically withheld from the amounts received by the OTC.
It is prohibited to carry out, through Obsidiam and licensed OTCs, the operation of transferring any quantity of crypto-assets to wallets that are sanctioned or flagged as a means of financing terrorism or serious and transnational crimes.
Obsidiam adopts automatic and manual compliance methods for the complete assessment of the KYC conditions of the buyer, whose transaction with crypto-assets will depend on prior authorization from the compliance team, regardless of the amount.
You, in the capacity of buyer, are aware of and fully agree that, if there is suspicion in transactions where payment has already been made, the platform may block the assets for the period necessary to confirm the regularity of the purchase.
9. CANCELLATIONS AND REFUNDS#
No user may claim ignorance of these terms regarding the volatility of the market price, as well as the risks that the activity involves and the irreversibility of the transaction once completed (delivery of the crypto-assets to the indicated wallet).
You are aware that only in cases where an error on the part of the platform is proven, after careful evaluation by the support team, will it be possible to request a refund of any transaction, and you must keep all the evidence capable of demonstrating the error that permits the refund. In the absence of proof, any refund request will be considered undue and abusive.
The amount considered for return will be the exact amount of the transaction, with the requester also being responsible for bearing the expenses of the refund operations, except in the hypothesis of an error attributable exclusively to the platform.
When the refund request is made through the Special Refund Mechanism (MED), the operation will be carried out exclusively in accordance with the criteria and rules established in Resolução BCB nº 103/2021 of the Banco Central do Brasil.
In the case of a refund via MED, the destination Pix key for the amounts to be returned must belong to the same holder of the account that made the payment; it is not possible to make a return to the account of a third party.
You agree that you may not request a refund, by any means, in a currency other than the one used to carry out the initial purchase, and expenses with currency exchange operations, when applicable, will be borne by the buyer.
Any disputes of payments made through the Platform must be resolved directly with Obsidiam Support, which will request the evidence it deems necessary.
The platform will not be responsible for any error attributable to the customer or users relating to financial movements, payment or purchase of crypto-assets, including when there is an error in the indication of the correct wallet for the operation.
10. PRIVACY AND SECURITY#
All documents and information collected for the onboarding will be used exclusively for the full performance of Obsidiam's compliance and will be processed pursuant to the LGPD.
When the customer user uses the services of the platform, whatever they may be, you are aware that your conduct is interpreted as legitimate consent under the terms of the LGPD – art. 7, item I.
You are aware of and agree with the sharing of your personal information, of natural and legal persons, during the compliance process with partners or authorities for the validation of identity.
Obsidiam reserves the right to request, whenever necessary, even after approval of the user's registration, documents or information relating to the accounting activities of the customer company.
If, when requested, you do not deliver any document necessary for carrying out the verification of your registration or history of financial or crypto-asset operations, your operations may be suspended at the OTC until the proper delivery.
11. GENERAL PROVISIONS#
If any provision of these Terms and Conditions of Use of the platform is considered invalid or ineffective by a judicial authority, this will not affect the validity of the other provisions, which will continue to be fully in force and applicable to all users.
You may not consider as a waiver on the part of Obsidiam any act of not demanding the enforcement of these terms.
Whenever necessary, Obsidiam may change these terms, in whole or in part, to adapt to the reality of its activities, due to legal or governmental regulation or, further, when it implements new services, without the need for individualized prior notice, it being sufficient for this purpose the publication of the new rules on the official website of the platform.
You declare that you fully agree with these terms of use and will observe them throughout the entire process of relationship with Obsidiam.
